Description and Service Details

Description (Service) Formerly the Surrogate Court
  • Probates Wills of persons who die either testate (with a will) or intestate (without a will)
  • Deals with contested claims against estates and disputed Wills trials
  • Local probated Wills less than 20 years old are kept at this court, Wills older than 20 years are kept in storage for 40 years and can be obtained through this office
    • Requests for copies of local probated Wills must be sent in writing to above address
    • Send $10 to cover copying and mailing (photocopies $2 per page)
    • Ontario Archives keep copies of probated Wills that are 60 years or older, call 416-965-4030
